Terms and Conditions
These Sale Conditions of the Vittello Online Store will be governed both for its interpretation and for its execution in accordance with the provisions of current legislation in Spain regarding distance selling and electronic commerce, and will apply in a subsidiarity manner, in everything that has not been foreseen in the same.
GEOGRAPHICAL SCOPE OF SALE:
The geographical scope of sale is peninsular Spain. For sales in the Balearic Islands, Canary Islands, Ceuta and Melilla, please consult.
PRICING POLICY:
The prices of all products have the VAT INCLUDED, reserving Vittello the right to modify the price of any product without prior notice, without affecting orders already confirmed and paid.
FABRICS, COLOURS AND MEASUREMENTS:
The colours and shades presented may vary depending on the monitor on which they are displayed and do not represent a contract at the time of purchase. It is recommended to request a sample that will be sent to your home once you reserve your sofa. The measurements are done by manual manufacturing and depending on the exact place of measurement of the items, there may be a variation of +/- 1 to 5 centimetres per sofa. VITTELLO ONLINE is not responsible for the error carried out by the customer when selecting a measurement, side of the chaise longue, upholstery or colour, given that VITTELLO ONLINE offers all the information as well as a graphic representation as approximate as possible.
TRANSPORT:
All shipping, packing, unloading, etc. expenses are included in the shipping costs. These shipping costs are FREE for the peninsula only for VITTELLO sofas “exclusive online – free shipping -.
For the rest of the sofas, the shipping cost will be calculated at the time of purchase. Shipping costs include transportation, delivery to the customer’s home, unpacking, assembly and removal of packaging. This does not include the installation of the article on the wall or the union of the different parts by means of screws. It is also possible to remove the old sofas after paying the agency the amount which you can check before they deliver your order.
In no case, will there be a crane service included since the customer must ensure before their order, that it will enter the room where it should be placed.
The postage will be made through an agency specialized in transporting sofas and / or furniture, in total confidence. The merchandise will be delivered within the schedule established by the delegation of the agency corresponding to your area (approximate time by phone call will be specified), which may be changed for reasons of force majeure, and will be held from Monday to Friday except in exceptional cases (see availability).
In the event that the client cannot receive the goods at said time, the delivery will be attempted on another day and time prior agreement with the destination agency, always during business hours and from Monday to Friday, since the merchandise will be in the agency closest to your home and will not be returned to the factory immediately. If the customer can not specify a delivery time within 5 business days following notification by the delivery agency, the merchandise may be returned to our factory, charging the shipping costs to the customer.
The delivery time for this agency is established, as a general rule, in a maximum of 15 working days from the agency picks up your product from our factory or warehouse (in the case of products in stock). The collection of goods is made daily with what a stock product can be delivered to your home, as a rule, in a maximum of 15 working days, counting from the next working day to the confirmation of your order.
NOTE 1: Claims for damages and / or breakages of merchandise must be notified to VITTELLO 2012 S.L. and / or to the transport company within 24 hours after receipt of said merchandise so that the claim is addressed and the problem corrected. In addition, during the months of August, September and December, the delivery times may be increased up to 10 more working days due to vacation and rest of the staff of transport agencies and material suppliers.
SHIPPING & RETURNS:
The Delivery Terms will be different according to products, measurements and / or materials / leather although they are between 50 and 60 working days. It will depend on the transport service chosen by the customer and if the product and / or fabrics are in stock. If you want to know the deadlines for delivery of your product more accurately, contact us. In all cases, the delivery terms will begin to count from the day following the reception in our bank account of the transfer / income corresponding to the payment of your order and you will receive in your email the order confirmation. All delivery times are indicated on working days, i.e. from Monday to Friday and excluding holidays. In case of default of the specified delivery date for each item in more than 20 working days, the buyer may choose to cancel the order and receive the amount paid. Failure to deliver will not be considered as such if the transport agency has not been able to locate the buyer through the information provided by the latter or due to force majeure. In case of return of merchandise: The instalments will be made within a period of less than 50/60 working days from the receipt of the goods in our warehouses. Any expense that entails the return if this is foreign to VITTELLO 2012 S.L., SL will be assumed by the customer. In the event that your shipment presents dents or damages due to transportation, you must indicate the anomalies in the delivery note of the carrier. No claims will be accepted after 24 hours of receiving the goods. Any claim that is due to damages in transportation must be addressed to VITTELLO 2012, S.L. in the indicated period. Remember never to throw away the packaging of the products until they are in perfect condition. Before opening any package, we kindly ask you to verify that all the products match the ones you requested (Model, Colour, Measurement, Finish, etc. …), making an immediate claim, in case there is any anomaly.
14 DAYS TEST: Non-refundable returns. No refunds of the sofa unless there is a defect in it caused before delivery, once the sofa is delivered to the home it will have 14 days’ testing period. Returns are not accepted after 14 calendar days from the date of delivery.
IMPORTANT NOTE: Products in liquidation that are in stock will be reserved a maximum of 72 h. until the order confirmation is made by paying the minimum 35% of the total order.
DISMISSAL:
In case of cancellation and / or withdrawal of any order for reasons unrelated to VITTELLO 2012, S.L. that is not in stock and its manufacture is necessary, that it has been more than 5 days since the confirmation of the order, any advance made is the property of VITTELLO 2012, S.L. as compensation for damages caused. This clause will not be applicable in the case of having exceeded the established delivery terms.
PAYMENT METHODS:
The forms of payment foreseen to pay for the orders placed in the Online Shop VITTELLO: Choice of payment mode. In this step you can choose how you want to pay for your purchase between the following forms of payment:

Financing 12 months without interest.
Deferments to 12 months without interest and without management fees. Example: for financing € 1,750, 6 months of grace, 12 instalments remaining € 145.83. Total amount owed: € 1,750. T.A.E 0% T.I.N 0%. Financing offered and subject to approval by Banco Popular.

PAYMENT DEADLINE AND ORDER CANCELLATION:
When the buyer has chosen the form of payment by bank transfer or deposit account, it must be made within a maximum of 3 business days from the date of order confirmation. If after 5 days no confirmation of payment is received, the order will be cancelled.
Satisfaction guarantee: If you are not satisfied with the merchandise, always in compliance with Law 47/2002, of December 19th on the Regulation of Retail Trade, for the transposition into Spanish law of Directive 97/7 / EC, in subject of distance contracts, and for the adaptation of the Law to various Community Directives for the organization of retail trade, Chapter II of Article Three, Articles 44 and 45, 100% of the value of the purchased merchandise will be refunded, at no cost to the client, if it has not been more than 7 days since the delivery of the same and as long as we return the item or items in perfect condition and with their original packaging. In any case, the transportation costs of the return will be borne by the customer. VITTELLO LIMITED WARRANTY:
WARRANTY COVERAGE: VITTELLO warrants that the VITTELLO brand product, as defined in this section, is free from defects in materials and workmanship during the warranty period specified below (from the date of purchase or delivery of the product) and in the country of acquisition. This contractual / limited warranty is limited to the replacement of the product or part recognized as defective by another identical or comparable, new or equivalent product or part. This warranty covers repair (parts and labour included) or replacement, as indicated below, during the warranty period specified below.
This commercial guarantee does not affect the legal rights of the consumer and user due to the lack of conformity of the product with the contract.
PRODUCTS OF THE VITTELLO BRAND – WARRANTY PERIOD:
Mechanisms or moving parts: 2 years. Electric motors: 2 years. Partenon, Prairie or Artificial Leather Upholstery: 5 years. Rest of fabrics: 2 years. Thick Leather upholstery: 5 years (cracking and depigmentation of the skin). Special skin upholstery: 5 years (cracking and depigmentation of the skin). Structure (frame and suspension): 2 years. Fillings: 6 months. Being consumable goods, the guarantee will be applied according to the characteristics of the product.
Whenever appropriate, and in the sole discretion of VITTELLO, or by virtue of the consumer legislation of the country of acquisition, VITTELLO may limit or extend the warranty period of the product.
Vittello provides customer service and assistance during the warranty period. For those articles whose commercial guarantee is more than to 2 years, after that period of time and in the event of suffering any incidence, the repair or replacement will proceed, depending on the nature and extent of the damage suffered, but in no case the return of the amount paid.
When the damage or defect affects only one or more covers and not the structure, and these must be replaced, the replacement of the damaged parts will be guaranteed, and some variation may occur in the dye. These changes in tonality will not be considered as a defect that could justify a lack of conformity.
EXCLUSIONS OF THE WARRANTY:
This contractual / limited warranty is not applicable when:
- The defects or failures are due to accidents, negligence or misuse, failure or defect of the electric current, external electrical circuits, an unusual physical or electrical tension, air conditioning or environmental control, effects of weather conditions or use of Items not provided by Vittello. 2. The modifications, repairs, service interventions or installation of the Product have been made by the Customer, persons not belonging to Vittello or its authorized contractors. 3. The use or installation of the Product does not conform to the VITTELLO documentation. 4. The defect of the product is due to any other reason that, in the sole discretion of VITTELLO, is not a consequence of a defect in the material or in the workmanship. 5. The customer has not followed all the procedures stipulated in this warranty.
LIMITATION OF LIABILITY:
The responsibility of VITTELLO is limited to the repair of the Product or its replacement. And in those cases where the requirements established in the law are fulfilled, the price reduction or the termination of the contract. In particular, Vittello will not be responsible for replacing or repairing the Product if the contractual / limited warranty is not applicable according to the reasons set forth above.
Except in the case of death or personal injury caused by the negligence of Vittello, its employees or the service provider, this Limitation of Liability represents Vittello’s full responsibility in relation to the products and services provided under this and the group Vittello will not incur any further obligation, duty or liability, of any kind by virtue of contract, tort (including liability for negligence) or otherwise for the Client.
VITTELLO is not responsible for failures or delays in the provision of assistance due to causes beyond its control. These circumstances include, but are not limited to, telephone service interruptions, airport closures that delay the delivery of parts, force majeure, weather conditions, strikes, and the impossibility of contacting the customer to confirm the deadlines.
